Municipal Court Mission

Our mission is to serve the public with integrity, professionalism, and respect in the performance of our daily duties; to diligently hold ourselves to a higher standard of excellence and to preserve the public trust.

The Mount Pleasant Municipal Court will at all times adhere to the South Carolina State Code of Laws and the policies and procedures as set forth by the South Carolina Court Administration in the application of justice, and by oath, solemnly vow to uphold and protect the rights and liberties of all individuals who appear before us.


Municipal Court sessions are scheduled Monday through Friday. The Clerk of Court’s Office schedules jury trials, processes warrants, conducts all transactions relating to the court docket, and adjudication of misdemeanor state violations, and municipal codes. Any questions pertaining to court hearings and jury duty service can be answered by calling the Municipal Court.

Continuance Requests


First continuance request:


All continuance request must be submitted in writing. There may be insufficient time to process a request received within 48 hours of the court date which could result in the case going forward as scheduled.

Second continuance request:


Second and subsequent continuance request must be submitted in writing. Second request also require proof of conflict and will be approved or denied by the judge. There may be insufficient time to process a request received within 48 hours of the court date which could result in the case going forward as scheduled.

Certified Copy of Dispositions

Under the Freedom of Information Act, §30-4-30, copies of dispositions, and other applicable information may be obtained by filling out the appropriate form provided by the Clerk of Court’s office.

Appeal


A Notice of Appeal

must be filed with the Mount Pleasant Municipal Court within ten (10) days of the court date. The appeal form will be provided upon request by the Clerk of Court’s office. The fine imposed by the judge, at time of sentencing, must be paid prior to filing the Appeal.


The Notice of Appeal

should include name, address, telephone number, and any error of law made by the judge in his/her finding of guilt.


The Court will file the appeal along with the judge’s return to the Court of Common Pleas for Charleston County. Notification of appeal hearing will be sent from the Court of Common Pleas to the address listed on the appeal paperwork.


Department of Motor Vehicles


Questions regarding driver’s license points, suspension, reinstatement, which police agency issued my ticket, may be addressed by contacting the Customer Service division of the Department of Motor Vehicles in Columbia, South Carolina at (803) 896-5000.


Motion for a New Trial


A motion for a new trial must be filed with the Clerk of Court’s office. The appropriate form will be provided for completion, to include, the reason for missing the assigned court date, name, address, telephone number, and citation number(s).


The clerk will assign a court date and time to come back before the original judge, who will make a determination whether or not to grant the motion for a new trial.
